Esto supone que vuelve a tener sus derechos\u00bb, apunta D\u00e1maris con gran alegr\u00eda.<\/span><\/li>\n<\/ul>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/cdn.20m.es\/img2\/recortes\/2015\/11\/30\/250650-620-282.jpg\" width=\"620\" height=\"282\" alt=\"Ni\u00f1o con espina b\u00edfida\" \/><\/p>\n<p>Encantada. Muy feliz. As\u00ed es como se siente D\u00e1maris Palacios y as\u00ed es como suena su voz al otro lado del tel\u00e9fono. No es para menos. Acaba de saber que el juzgado de los social n\u00famero 3 de Oviedo ha fallado a su favor y que <strong>su hijo Paco, con espina b\u00edfida, recuperar\u00e1 el grado de discapacidad del 33%<\/strong> que le asignaron en 2013 y que <a title=\"Retiran a un ni\u00f1o con espina b\u00edfida el grado de discapacidad del 33% que ten\u00eda reconocido \" href=\"http:\/\/www.20minutos.es\/noticia\/2617115\/0\/retiran\/nino-espina-bifida\/grado-discapacidad-33\/\">la Consejer\u00eda de Servicios y Derechos Sociales de Asturias le retir\u00f3 el a\u00f1o pasado<\/a>.<\/p>\n<p>Con ese porcentaje, este peque\u00f1o de Gij\u00f3n <strong>vuelve a tener acceso a una serie de prestaciones<\/strong> que desde agosto hab\u00edan perdido. Es el caso de una reducci\u00f3n en los costes de las terapias que necesita, como rehabilitaci\u00f3n y logopedia, y de una plaza de inclusi\u00f3n en el colegio. \u00abAfortunadamente esta \u00faltima no la hab\u00edamos perdido gracias a lo bien que se ha portado con nosotros el centro\u00bb, explica su madre.\u00a0<\/p>\n<p><span>La sentencia, contra la que cabe recurso, determina que la revisi\u00f3n \u00ab<\/span><strong>no fue por la mejor\u00eda o alteraci\u00f3n de la discapacidad<\/strong><span> originada por la deficiencia cong\u00e9nita, sino por un &#8216;criterio de discrepancia con la valoraci\u00f3n inicial&#8217;, y siendo ello as\u00ed no queda sino confirmar el grado inicial del 33%\u00bb.<\/span><\/p>\n<p>\u00abMi hijo tiene una discapacidad y\u00a0<strong>necesita unas determinadas cosas que hab\u00eda perdido<\/strong>. Esto supone que vuelve a tener sus derechos.
